Free Duties & Responsibilities of a Notary Questions and Answers

Question 1

What is the primary duty of a notary public?

Accepted Answer

Act as a witness to document signing

Answer

The primary duty of a notary public is to act as an impartial witness to the signing of documents. By doing so, they verify the identity of the signer and confirm that the signature was made willingly. This critical role helps to deter fraud and ensures the authenticity of signatures on important legal and business documents.

Question 2

Which of the following is NOT a responsibility of a notary public?

Accepted Answer

Provide legal advice

Answer

A notary public is strictly prohibited from providing legal advice. Their role is limited to witnessing signatures, administering oaths, and certifying copies, not interpreting legal documents or advising on their implications. Providing legal advice would constitute the unauthorized practice of law and is outside the scope of a notary's duties.

Question 3

When is a notary required to refuse to perform a notarization?

Accepted Answer

If the signer does not have valid ID

Answer

A notary public is legally required to refuse a notarization if the signer does not present valid and acceptable identification. Verifying the signer's identity is a fundamental duty to prevent fraud and ensure the integrity of the notarial act. Without proper identification, the notary cannot confirm who is signing the document.

Question 4

What is required of a notary when witnessing a signature?

Accepted Answer

Verify identity and willingness

Answer

When witnessing a signature, a notary public is required to verify the signer's identity using acceptable identification and ensure that the signer is acting willingly and without coercion. This dual verification ensures the authenticity of the signature and the integrity of the document. The notary's role is to confirm 'who' is signing and that they are doing so 'voluntarily'.

Question 5

What must a notary do before completing a notarial certificate?

Accepted Answer

Have the signer appear in person

Answer

Before completing a notarial certificate, a notary public must have the signer appear in person before them. This personal appearance allows the notary to verify the signer's identity, witness the signature, and ensure the signer is acting willingly. It is a fundamental requirement for the validity of most notarial acts.
