  1. Under PUWER 1998, what specific requirement exists for work equipment used between sunset and sunrise or in dark conditions?

Answer: Suitable and sufficient lighting must be provided for the work equipment and the area around it

PUWER Regulation 21 requires that suitable and sufficient lighting is provided at any place where a person uses work equipment. This is particularly critical during night work or in enclosed spaces where natural light is insufficient to allow safe operation and observation of hazards.

  2. What is the purpose of a 'pre-use check' on lifting accessories such as slings?

Answer: To identify visible defects such as cuts, abrasion, corrosion or distortion before each use

Pre-use checks are visual inspections carried out by the user before each use of a lifting accessory. They identify obvious defects such as cuts, fraying, kinking, corrosion, distortion, missing labels, or damaged fittings that could lead to failure under load. They supplement but do not replace thorough examinations.

  3. A forklift truck is classified as what type of equipment under both PUWER 1998 and LOLER 1998?

Answer: It is both work equipment under PUWER and lifting equipment under LOLER

A forklift truck is classified as work equipment under PUWER 1998 (covering general safety requirements, training, maintenance) and as lifting equipment under LOLER 1998 (covering planning of lifting operations, thorough examination, SWL marking). Both sets of regulations apply simultaneously.

  4. What hazard does a trapped key interlock system protect against?

Answer: Unauthorised access to a danger zone while machinery is still energised or running

A trapped key interlock system uses a sequence of locks and keys to enforce a safe order of operations. The key to access the danger zone can only be released after the machine has been isolated and locked off. This mechanical interlock prevents the guard being opened while the machine is running and prevents the machine being restarted while the guard is open.

  5. Under PUWER 1998 Regulation 22, what duty is placed on employers regarding markings on work equipment?

Answer: Equipment must be clearly marked with any marking appropriate for health and safety, such as maximum speed or SWL

Regulation 22 requires work equipment to bear appropriate health and safety markings that are clearly visible. These include maximum rotation speeds, safe working loads, direction of travel indicators, warning symbols, and any other markings necessary for safe use as identified by the risk assessment.

  6. When must a thorough examination of lifting equipment be carried out after it has been involved in an 'exceptional circumstance'?

Answer: Before the equipment is returned to service

Under LOLER Regulation 9, if lifting equipment has been subject to exceptional circumstances such as an accident, collision, overload, or prolonged period out of use, a thorough examination must be carried out before it is put back into service. This ensures any hidden damage is identified before further use.
