  1. A NC notary uses an acknowledgment certificate on an affidavit that was supposed to use a jurat. The document is filed with a court. This error:

Answer: Could invalidate the sworn nature of the affidavit since no oath was administered

Using an acknowledgment certificate on an affidavit is a substantive error. An affidavit requires an oath administered by the notary (jurat). Without the oath, the document is not a sworn statement — this can seriously affect its legal validity and any perjury implications.

  2. Under NCGS Chapter 10B, a notarial certificate completed in a language other than English is:

Answer: Generally not acceptable for NC notarial acts — the certificate should be in English

NC notarial certificates should be completed in English. While NC law does not have an absolute prohibition on foreign language certificates, the NC SOS guidance strongly recommends English certificates for NC notarizations to ensure they are recognizable and valid under NC law.

  3. A loose notarial certificate (a separate page from the document) must:

Answer: Clearly identify the document it pertains to by title, date, and number of pages

A loose notarial certificate that is not physically embedded in a document must clearly identify the document it relates to — typically by document title, date, and number of pages. This prevents the certificate from being detached and reattached to a different document.

  4. Under NC law, a notarial certificate for a document that was signed in counterparts (multiple identical copies signed separately) should:

Answer: Identify that it covers the signer's original counterpart signature

When a document is signed in counterparts, each signer signs a separate copy. The notarial certificate for each counterpart should relate to that specific copy and the specific signer who appeared before the notary — not make general claims about all counterparts.

  5. Under NCGS Chapter 10B, if a document is recorded in the register of deeds with a defective notarial certificate, the recording:

Answer: Is valid as recorded but the underlying notarization may be challengeable

Recording a document with a defective certificate does not cure the defect. The recording itself may stand as a public notice, but the underlying notarization — if defective — remains challengeable. The defect may affect the document's legal effectiveness.

  6. A NC notarial certificate states the notarization occurred on 'the ___ day of ___.' The notary left both blanks unfilled. Under NCGS Chapter 10B:

Answer: The court may apply the substantial compliance doctrine if the date is determinable from other evidence

A completely missing date is a serious defect. Under NCGS §10B-68, a court may apply substantial compliance if the date can be determined from surrounding evidence. However, a party may not simply fill in an estimated or assumed date.
