Environmental Compliance Inspector Inspection Procedures & Techniques 3 — Questions and Answers
Question 1: During an air emissions inspection, an inspector uses EPA Method 9 (visible emissions). What does this method evaluate?
- Total suspended particulate concentration in mg/m³
- The opacity of stack emissions as a percentage (Correct answer)
- Carbon monoxide concentration in stack gas
- Ambient ozone levels near the facility
Correct answer: The opacity of stack emissions as a percentage
EPA Method 9 is a visual method where a certified observer estimates the opacity of plume emissions as a percentage, used to identify excess particulate emissions.
Question 2: When documenting a suspected spill site, an inspector should photograph evidence in which order?
- Close-up details first, then mid-range, then wide establishing shots
- Wide establishing shots first, then mid-range, then close-up details (Correct answer)
- Only close-up shots are needed for enforcement
- Photographs are optional if written notes are thorough
Correct answer: Wide establishing shots first, then mid-range, then close-up details
Starting with wide establishing shots provides context, then progressively closer shots document specific evidence while maintaining the spatial relationship of findings.
Question 3: A facility claims a process upset caused an emission exceedance and invokes an affirmative defense. The inspector should:
- Accept the claim and close the file
- Document the claim, request supporting records (maintenance logs, operator logs), and continue the inspection (Correct answer)
- Immediately recommend criminal charges
- Transfer the case to the facility's legal counsel
Correct answer: Document the claim, request supporting records (maintenance logs, operator logs), and continue the inspection
The inspector must document the facility's claim and obtain supporting operational records to evaluate whether the upset defense criteria are genuinely met.
Question 4: Which chain-of-custody practice is essential when collecting environmental samples for potential litigation?
- Labeling samples only with inspector initials
- Maintaining a continuous written record of sample possession, transfer, and storage (Correct answer)
- Allowing the facility to courier samples to the laboratory
- Collecting samples in facility-provided containers
Correct answer: Maintaining a continuous written record of sample possession, transfer, and storage
An unbroken chain of custody documents every transfer of the sample, ensuring evidentiary integrity and admissibility in enforcement proceedings.
Question 5: An inspector arrives at a hazardous waste facility and the owner refuses entry, citing the Fourth Amendment. The inspector should:
- Force entry to prevent destruction of evidence
- Leave and obtain an administrative search warrant before returning (Correct answer)
- Accept the refusal and close the case
- Contact local police to compel immediate entry
Correct answer: Leave and obtain an administrative search warrant before returning
When entry is refused, inspectors must obtain an administrative search warrant from a magistrate, which courts routinely grant upon showing of a valid regulatory inspection program.
Question 6: A facility's stormwater pollution prevention plan (SWPPP) has not been updated in three years despite two facility expansions. This finding indicates:
- Full compliance because the original plan was approved
- A likely permit violation since SWPPPs must be updated when site conditions change materially (Correct answer)
- Only a documentation deficiency with no regulatory consequence
- A matter for the state fire marshal, not an environmental inspector
Correct answer: A likely permit violation since SWPPPs must be updated when site conditions change materially
NPDES stormwater permits require SWPPPs to be amended whenever significant changes to site operations or layout could affect stormwater quality.
Question 7: During a RCRA hazardous waste inspection, an inspector notices containers labeled 'unknown liquid.' The facility cannot identify the contents. The inspector should classify these containers as:
- Non-hazardous until laboratory results confirm otherwise
- Hazardous waste until the facility can demonstrate otherwise, and document the finding (Correct answer)
- Recyclable materials per RCRA exemptions
- Properly managed waste requiring no further action
Correct answer: Hazardous waste until the facility can demonstrate otherwise, and document the finding
Under RCRA, unidentified liquids in a hazardous waste area must be treated as hazardous waste until characterized, and the inspector must document the nonconformance.
