What is the key difference between a jurat and an acknowledgment?
Answer: A jurat requires the signer to sign in the notary's presence and take an oath.
A jurat requires the signer to sign the document in the physical presence of the notary after taking an oath or affirmation regarding the truthfulness of the document's contents. For an acknowledgment, the signer only needs to appear and acknowledge a pre-existing signature as their own.
For a jurat, the signer must be administered an oath or affirmation. What is the purpose of this oath?
Answer: To have the signer swear or affirm that the statements in the document are true.
The oath or affirmation is a solemn promise made by the signer, under penalty of perjury, that the contents of the document they are signing are true and correct. This is the core function of a jurat.
A document is presented for a jurat, but the signer has already signed it. What must the Arizona notary instruct the signer to do?
Answer: Sign the document again in the notary's presence.
A fundamental requirement for a jurat is that the signing occurs in the notary's presence. If the document is pre-signed, the signer must re-sign it in front of the notary for the jurat to be validly performed.
The notarial certificate for a jurat typically includes the words:
Answer: 'Subscribed and sworn to (or affirmed) before me...'
This specific wording, 'Subscribed and sworn to (or affirmed) before me,' is the hallmark of a jurat certificate. 'Subscribed' means signed, and 'sworn to (or affirmed)' refers to the oath administered by the notary.
An individual asks you to perform a jurat on an affidavit but refuses to take an oath or affirmation. What should the notary do?
Answer: Refuse to perform the jurat.
Administering an oath or affirmation is a non-negotiable, essential element of a jurat. If the signer refuses to take the oath or affirmation, the notary cannot complete the jurat and must refuse the service.
When performing a jurat, the notary must positively identify the signer. Which of the following is NOT an acceptable method of identification in Arizona?
Answer: A social security card.
A social security card is not an acceptable form of identification for notarial purposes in Arizona because it does not contain a photograph, physical description, or signature. Acceptable IDs must be government-issued and contain these elements.
